It is almost as though he just doesn’t give up. Clive Palmer has now been rejected by Queensland Supreme Court Justice John Bond in a claim against the liquidators FTI Consulting who have recently taken over Queensland Nickel.
 
The claim stated at 1.2 billion dollars would be deemed a “startling affront to justice” according to Justice Bond.

During the case, Justice Bond asked senior counsel for Mr Palmer how it was arguable that the joint ventures wouldn’t be contractually liable for their proportions of liabilities … such as in relation to employee entitlements.
Justice Bond said: “I received no answer, other than a change of subject to focus on a trustee’s right of indemnity”. The application was dismissed with Justice Bond calling for submissions on costs.”

It is clear that Clive Palmer overshot the mark on this one, and now due to pay further court costs…rather counter productive if you ask us.

The Defender is being defended…

An ongoing debate and now court case has left Townsville’s sunken icon under the water for a little longer. The Defender is a 120 old ship which lives partially submerged in the Ross Creek here in Townsville just outside of the Museum of Tropical Queensland and has been there for 7 years now.

It is believed that the ship could sail again with enough money and will to save it. You might ask well why isn’t it then? The ship is glorious, a masterpiece, an antique of sorts. Well the reason isn’t one you’d expect.

An older bloke by the name of Brett Devine claims to have purchased the vessel from the Dick family for $1 (yes, that’s right, a single dollar) on the condition that he would salvage and restore the ship in conjunction with the Adelaide Nautical College. Keeping to his end of the bargain, Mr Devine has attempted to attend Townsville on several occasions to salvage the vessel although his ownership is appearing harder to prove then what he expected.

After countless visits to the courts and what seemed like a rather unrequired legal debate, it is noted in a statement by a Department of Transport and Main Roads spokesperson that Les Dick is remained responsible for all costs associated with the salvage of the Defender. Further more, “An order was issued in Townsville District Court on August 19 directing Les Dick, the owner of the tall ship Defender, to remove it from Queensland waters by October 30,” the statement read.

Tough New QLD Smoking Laws – Be Warned!

Extreme changes have been put into effect regarding smoking laws in Queensland. It is clear that these changes are dramatic and immediate according to the ABC.  Here is an excerpt from the below link:

“As of today, lighting up will be outlawed at or near childcare and aged care facilities, bus stops and taxi ranks, public pools, children’s sporting venues, skate parks and outdoor malls.”

Furthermore, as of February 2017, smoking will also be banned within 10 meters of campsites, picnic areas and boat ramps – all of which very common places to find people smoking.

Considering this, we highly recommend that you make yourself fully aware of these laws as failing to head them will most likely result in fines or potentially a criminal conviction.
