Fundamentally, testamentary documents provide for revocable dispositions of property and only take effect on death. Documents that are irrevocable or are intended to have effect at any time other than death are not testamentary. The requirements of valid testamentary documents in Queensland is prescribed by the Succession Act 1981 (Qld). The legislation establishes a number of fundamentals that must be considered and incorporated when preparing testamentary documents.

Examples include:

  • The property that may be disposed of by the will,
  • The minimum age for making a will,
  • The need for writing,
  • The capacity of individual making the will, and
  • The witness requirements.
