Advertiser Beware

As you may not know, the Queensland Government passed the Transport Operations (Road Use Management) (Offensive Advertising) Amendment Act 2017. As this amendment comes into force, those of you with small or large businesses need to consider how you may wish to advertise especially if you wish to do so on your fleet vehicles in a provocative manner.

Under this amendment, any advertisement that breaches the Australian Association of National Advertisers Code of Ethics can have the effect of having the vehicle registration cancelled, if deemed a breach by the Advertising Standards Bureau. This Code of Ethics covers areas of advertising such as crude or vulgar language, over sexualisation and even adult themes deemed inappropriate. If a notice is issued, you will have 14 days to hand in your number plates or face up to 20 penalty units in fines.

If you are unsure whether your advertising idea will breach the Code of Ethics or you need any other form of Commercial Law advice, come and talk to the team at Strategic Lawyers. We have friendly experienced solicitors that want your local business to thrive, that’s why we give Strategic Legal advice at a Fixed-Fee price.
